Important. Section 22 explains dispute resolution, including individual arbitration and a class-action waiver, which limit how you can bring claims in court. Sections 15–17 also limit warranties and our liability. Review the full Terms before using HomeWise Agent.
These Terms of Service ("Terms") are between you and HomeWise Agent LLC ("HomeWise Agent," "we," "us"). They govern access to our website, apps, and related services (the "service"). By registering, clicking accept, or using the service, you agree to these Terms, our Privacy Policy, and our Messaging Policy. If you disagree, do not use the service.
1. Who may use the service
You must be at least 18 and legally able to enter a contract where you live. The service is built for adults who own, rent, or manage real property—not for minors.
2. What we provide
HomeWise Agent helps you organize properties, schedule maintenance reminders, send notifications, view ZIP-based cost estimates, discover local service providers, and use Homie, our AI assistant. Plans, limits, and features may change over time.
We are a software tool for tracking and communication—not a property manager, landlord, tenant agent, contractor, inspector, insurer, broker, or emergency responder. We are not a party to any agreement between you and a tenant, vendor, or other third party.
Features labeled beta, preview, or early access are offered for evaluation only, may change or end without notice, and are excluded from warranties or uptime commitments.
3. Accounts and security
- Provide accurate registration information and protect your login credentials.
- You are responsible for activity under your account.
- Report suspected unauthorized access to support@homewise-agent.com promptly.
- Trial periods, plan caps, and usage limits are shown at signup and in the app.
- We may suspend or close accounts that violate these Terms, abuse the platform, or break applicable law.
You may request account deletion by emailing support@homewise-agent.com or through in-app support. We will delete or retain data as described in our Privacy Policy and as required for billing, security, or legal compliance.
4. Plans, payments, and refunds
Paid plans are billed through Stripe. Price, billing interval, trial terms, and cancellation options appear at checkout and under Profile → Manage billing.
- Free plans are provided without guaranteed service levels beyond what law requires.
- Renewal — paid subscriptions renew automatically until you cancel before the renewal date.
- Cancellation — cancel anytime in your account; access to paid features typically continues through the current billing period unless checkout states otherwise.
- Refunds — fees are generally non-refundable except where law requires or we state otherwise at purchase.
- Failed charges — we may pause paid features until payment succeeds; after 30 days of non-payment we may downgrade or close the account.
- Price changes — we may adjust pricing with at least 30 days' notice by email or in-app; continued use after the effective date means you accept the new price.
- Taxes — listed prices may exclude taxes added at checkout where applicable.
- Billing disputes — notify us within 60 days of a charge you dispute, or you may lose the right to contest it except where law forbids that limitation.
5. Reminders, SMS, and email
You may configure maintenance reminders to phone numbers and email addresses you add. Outbound messages are sent by HomeWise Agent from our business number and domain—not from your personal phone or inbox.
You must have permission to message each recipient and comply with applicable laws (including TCPA and CAN-SPAM). The app requires you to confirm consent before saving notification contacts. See our Messaging Policy for frequency, HELP, STOP, and delivery details.
Delivery is best-effort and depends on carriers, email systems, networks, and recipient devices. We do not guarantee that any reminder will be sent, delivered, read, or acted on in time. Do not rely on HomeWise Agent as your only way to ensure maintenance gets done.
The service is not for emergencies. For fire, gas leaks, flooding, electrical hazards, or other immediate danger, call emergency services or qualified professionals without delay.
6. Data about tenants and other third parties
When you add names, phone numbers, emails, or other details about tenants, vendors, or third parties, you control that information and HomeWise Agent processes it on your behalf to run reminders and related features. You must:
- Have a lawful basis to collect and use that information;
- Give any notices those individuals are entitled to; and
- Honor their privacy rights (access, correction, deletion, opt-out).
If we receive a verified privacy request about data you submitted that we cannot resolve without your direction, we will notify you.
7. Your content
You own property details, reminders, notes, photos, and other materials you submit ("Your Content"). You grant HomeWise Agent a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely to operate, secure, and improve the service for you.
You represent that you have the rights and consents needed to submit Your Content and that it does not violate law or anyone else's rights.
8. Homie and other AI features
Homie and related AI tools generate general information using artificial intelligence. Output may be wrong, incomplete, or outdated. It is not professional legal, financial, engineering, or contractor advice. You are solely responsible for decisions you make based on AI responses.
9. Estimates, listings, and contractors
Cost estimates, pro listings, and contractor information are provided for convenience. We do not verify licensing, insurance, pricing, availability, or work quality. Any arrangement with a third-party provider is between you and that provider at your own risk.
10. Third-party platforms
The service relies on outside providers—for example hosting, authentication, databases, SMS, email, payments, maps, and AI. We are not liable for their outages, delays, policy changes, security incidents, or other failures.
Use of third-party-powered features may also be subject to their terms. A current provider list appears in our Privacy Policy.
11. Rules of use
You agree not to:
- Use the service unlawfully, fraudulently, or to harass or spam anyone;
- Message people without consent or in violation of messaging laws;
- Access data or accounts you are not authorized to use, or bypass limits or paywalls;
- Scrape, mirror, reverse-engineer, or resell the service except where law allows;
- Use the service to develop competing products, train external models, or run commercial benchmarks;
- Use the service for tenant screening, credit, insurance, housing eligibility, or other regulated decisions it is not designed to support;
- Upload malware or material that is illegal, defamatory, or infringing.
We may investigate misuse and cooperate with authorities. Serious violations may lead to immediate suspension or termination without refund.
12. Availability and changes
We work to keep the service running but do not promise uninterrupted, error-free, or secure operation. We may change, pause, or discontinue features or the entire service. Where practical, we will give paid users reasonable notice before material adverse changes. We do not guarantee a specific uptime percentage.
13. What the service is not
HomeWise Agent helps you record and schedule maintenance—it does not perform work, ensure compliance, or replace your judgment. Specifically:
- Notifications are not guaranteed. Email, SMS, and in-app alerts depend on third parties and device settings.
- You own the work. Inspections, repairs, and upkeep remain your responsibility.
- General information only. Templates, checklists, estimates, and Homie answers are not legal, tax, insurance, or compliance advice.
- Accuracy depends on your inputs. We are not responsible for losses from incomplete or incorrect data you enter.
14. Our intellectual property
The service, branding, software, and original content are owned by HomeWise Agent LLC and protected by intellectual-property laws. Do not use our names or marks without written permission.
15. Warranty disclaimer
THE SERVICE AND ALL CONTENT—INCLUDING REMINDERS, ESTIMATES, AI OUTPUT, AND THIRD-PARTY MATERIALS—IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR SECURE OPERATION.
Some jurisdictions limit warranty disclaimers; where that applies, this section is effective only to the extent permitted.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HomeWise Agent LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, PROPERTY DAMAGE, MISSED MAINTENANCE, TENANT DISPUTES, FINES, REGULATORY PENALTIES, OR BUSINESS INTERRUPTION—EVEN IF WE WERE ADVISED SUCH DAMAGES WERE POSSIBLE.
Cap. Our total liability for all claims relating to the service will not exceed the greater of (a) fees you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). For free accounts, the cap is $100.
Sections 15 and 16 reflect a fundamental part of our agreement. Some jurisdictions do not allow certain limits; there, our liability is reduced only to the minimum amount law permits.
17. Your responsibility to defend us
You will defend, indemnify, and hold harmless HomeWise Agent LLC and its officers, employees, contractors, affiliates, and licensors from third-party claims, losses, and expenses (including reasonable attorneys' fees) arising from: (a) Your Content; (b) your use of the service; (c) your breach of these Terms or applicable law; (d) your communications with recipients—including claims you lacked permission to contact someone; or (e) property damage, injury, or financial loss tied to property you manage through the service.
We will notify you of covered claims and cooperate reasonably. You may not settle any claim that imposes obligations on us without our prior written consent.
18. Ending your access
You may delete your account at any time. We may suspend or terminate access immediately for Terms violations, non-payment, risk to us or others, or legal requirements. When access ends, your right to use the service stops and we may delete Your Content after a reasonable period per our Privacy Policy.
Provisions that should survive termination—including ownership, licenses, disclaimers, liability limits, indemnity, arbitration, governing law, and general terms—remain in effect.
19. Copyright (DMCA)
We respond to valid copyright notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Send notices to support@homewise-agent.com with subject "DMCA Notice" and the information required by 17 U.S.C. § 512(c)(3). Repeat infringers may lose their accounts.
20. Export and sanctions
You may not use or export the service in violation of U.S. export controls or sanctions. You represent that you are not in an embargoed country or on a U.S. government restricted-party list.
21. Events beyond our control
Neither party is liable for delay or failure to perform (except payment obligations) caused by events outside reasonable control, such as natural disasters, war, terrorism, government action, labor disputes, utility or internet failures, or third-party provider outages.
22. Dispute resolution and arbitration
Read this section. Except for the exceptions below, you and HomeWise Agent agree to resolve disputes through binding individual arbitration, not court trials or class actions.
- Try to resolve it informally first. Email support@homewise-agent.com with a short description of the dispute and what you want. If we cannot resolve it within 60 days, either party may start arbitration.
- Arbitration process. Disputes arising from these Terms or the service will be decided by a single arbitrator through JAMS under its Streamlined Arbitration Rules. The hearing will be held in New Albany, Indiana unless you are a consumer who chooses a remote hearing.
- No class actions. Claims must be brought individually. An arbitrator may not hear a class, collective, or representative proceeding.
- Court exceptions. Either party may bring (a) an individual claim in small-claims court within that court's limits; or (b) a claim for injunctive relief to stop unauthorized use or intellectual-property infringement.
- Opt-out. Within 30 days of first accepting these Terms, email support@homewise-agent.com with subject "Arbitration Opt-Out," your name, account email, and a clear statement that you decline arbitration.
- Federal Arbitration Act. This agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.
23. Governing law and courts
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles. Except as provided in Section 22, exclusive jurisdiction for disputes not subject to arbitration lies with the state and federal courts located in Floyd County, Indiana, and you consent to personal jurisdiction and venue there.
24. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy, Messaging Policy, and plan terms at checkout are the full agreement between you and HomeWise Agent.
- Notices. We may notify you by account email, in-app message, or website posting. You agree to electronic notices.
- Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition, or asset sale.
- Severability. If one provision is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision once does not waive future enforcement.
- Time to sue. Where permitted by law, any claim must be filed within one (1) year after it arises or be permanently barred.
- Relationship. Nothing here creates a partnership, joint venture, agency, or employment relationship.
25. Updates to these Terms
We may revise these Terms by posting an updated version and changing the "Last updated" date. For material changes affecting paid users, we will try to give at least 30 days' notice by email or in-app, except where law or security requires shorter notice. Continued use after the effective date means you accept the revision. If you do not agree, stop using the service.
